infringement proceedings
We represent our clients in IPRs before the PTAB and assist in coordinating infringement proceedings in the United States, particularly in cross-border cases.
An inter partes review (IPR) is a procedure for challenging a US patent. The procedure is conducted by a Patent Trial and Appeal Board (PTAB) of the United States Patent and Trademark Office (USPTO). IPRs are similar in some aspects to an opposition procedure before the EPO/DPMA and in other aspects to an invalidity action before the UPC/BPATG.
IPRs are mostly used by European companies to challenge the legal validity of a US patent when an infringement suit based on this US patent is pending in a civil court. We are happy to support you in implementing the IPR. If required, we can also coordinate the infringement proceedings in the USA, as well as parallel proceedings in Europe, and work with law firms of your choice or from our network that specialize in infringement proceedings.
Washington - Munich
By combining both locations, we offer our clients efficient litigation with minimal effort.
Infringement and invalidity proceedings in the USA are often associated with significantly greater effort for European clients than in DE/EP proceedings. This is due on the one hand to the specific procedural structure in the USA - due, among other things, to discovery and necessary expert opinions - and on the other hand to the different legal opinions in the jurisdictions.
Our location in Munich allows us to be there for you directly on site and to be reachable during your business hours. With our office in Washington, DC, we are also in close proximity to relevant authorities, courts and other law firms involved in the proceedings.
Through streamlined and efficient procedural management and a deep understanding of the different legal systems, we do everything we can to ensure that infringement and invalidity proceedings are conducted in a result-oriented manner and with the least amount of effort for you.
