We represent our clients in Post Grant Proceedings before the UPC, EPO, and GPTO. We assist in coordinating the infringement proceedings in Europe with ongoing infringement proceedings in the United States.<\/p>\n

An inter partes review (IPR) is a procedure for challenging a US patent. The proceedings are conducted by a Patent Trial and Appeal Board (PTAB) of the United States Patent and Trademark Office (USPTO). IPRs are similar in some aspects to opposition proceedings before the EPO\/GPTO and in other aspects to nullity proceedings before the UPC\/German Federal Patent Court.<\/p>\n

In most cases, IPRs are used by European companies to challenge the validity of a US patent if an infringement action based on this US patent is also pending before a civil court. We will be happy to support you in conducting the IPR. If desired, we can also coordinate the infringement proceedings in the USA, as well as parallel proceedings in Europe. On the one hand, this is caused by the specific procedural structure in the USA, including discovery and the need for expert opinions. On the other hand, this results from the different legal interpretations in the jurisdictions.<\/p>
